Without prejudice to any more severe penalty under any other law, anyone who commits any of the following shall be punished by imprisonment and a fine not less than AED 100,000 and not exceeding AED 1,000,000, or by either penalty:

Forging or counterfeiting a registered trademark in a misleading way for similar goods or services.

Using a counterfeit trademark for commercial purposes with knowledge of its nature.

Misusing another person’s trademark in bad faith on goods or services.

Possessing tools or materials intended for forging or counterfeiting registered or well-known trademarks.

Importing or exporting goods bearing counterfeit trademarks with knowledge of their nature.
